Right of withdrawal

The German Widerrufsbelehrung is the legally binding version. This is a translation.

1. Your contract partner for the purchase

Paid TONO Pro licenses (subscription and lifetime) are sold by Lemon Squeezy as reseller (merchant of record):

The seller named at checkout and on your invoice is the one that counts. The statutory right of withdrawal exists against Lemon Squeezy. The withdrawal information Lemon Squeezy gives you at checkout and in the order confirmation, and Lemon Squeezy’s buyer terms, are binding. We, Julian Ivanov, develop and license TONO but are not the seller. The following sections summarize the statutory rules for your orientation.

2. Right of withdrawal

If you are a consumer, you have the right to withdraw from the purchase contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.

To exercise the right of withdrawal, you must inform Lemon Squeezy of your decision to withdraw from the contract by an unequivocal statement (e.g. a letter sent by post or an email). Use the contact options and the withdrawal option that Lemon Squeezy names in your order confirmation and under your orders at Lemon Squeezy, or write to the address above. You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you don’t know how to reach Lemon Squeezy, write to us at kontakt@julian-digital.de. We will help you and forward any withdrawal we receive to Lemon Squeezy without delay. The fastest way, though, is to declare the withdrawal to Lemon Squeezy directly.

3. Effects of withdrawal

If you withdraw from the contract effectively, Lemon Squeezy must reimburse all payments received from you without undue delay and in any event not later than fourteen days from the day on which it was informed of your withdrawal. The reimbursement uses the same means of payment you used for the original payment, unless expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

Once refunded, your Pro license ends; TONO then carries on as TONO Free.

4. Early expiry for digital content

TONO Pro is digital content not supplied on a tangible medium. For such a contract, the right of withdrawal expires early once the seller has begun performing the contract (for example by providing your license key) after you

1. expressly consented to the seller beginning performance before the end of the withdrawal period,
2. acknowledged that by giving this consent you lose your right of withdrawal once performance begins, and
3. the seller provided you with a confirmation of the contract on a durable medium (e.g. by email) that records your consent and acknowledgment

(§ 356(5) BGB). Whether you gave this consent follows from Lemon Squeezy’s checkout and your order confirmation. If any of these conditions is not met, you keep the right of withdrawal for the full fourteen days.

Independently of this, you can cancel a subscription at any time, effective at the end of the current billing period (see the license terms, section 5).

5. Refunds beyond the right of withdrawal

Lemon Squeezy decides on refunds to which there is no statutory entitlement under its buyer terms. If TONO does not work for you as described, write to us anyway: the problem can often be solved, and if not, we can arrange a refund through Lemon Squeezy in individual cases. Your statutory rights in the event of defects remain unaffected.
